Book 1: introduction to law
This book includes both the theory of law and the
theory of rights….how to use what is called
the law
to
regulate who should have
the right
???

Part 1: the law.
Chapter one: Nature of law
Definition of law:
law is a body of
general and abstract
rules which regulates
the
social
conduct of people and enforced by a
sanction
.

Characteristics of legal rule
1- social rules:
- It regulates
the social
conduct of
individuals in
the society
- Related only
to external
conduct (acts)
not internal
thoughts
2- general : applied on
all persons.
Ex in crimes
punishment is applied
on any person commit
it.
General even if related
to one person: ex: the
rule defining age of
president … also
general because it is
applied on all
candidates
3-enforced by a
sanction:
Imposed by the state
if not respected
voluntarily.
It may be criminal
such as violating the
rules of traffic.
Administrative: ex: if
public employee did
not perform his
duties
Or civil in case of
breach of contract

Chapter two: law, morality and
religion
-
definition:
*
religious rules:
are those ordered by
God and found in sacred books
*
moral rules:
are those presenting the
general opinion of what is good and what is evil in the
society.

-
punishment :
*
religious rules:
sanctioned by god in this life or
the other life.
*
moral rules:
only sanctioned by social
disrespect.
*
law:
sanctioned by the public authority in the stat.

-
control:
Law only govern the external acts while religion and
morals govern external acts and internal thoughts

finally
Some rules are
the same
in religion, morals and law
such as forbidding killing or stealing.
while some others
are different
: for ex: forbidding
planting rice in upper Egypt is only made by law while
mercy and charity are only ordered by morals and
religion not by law
